About Breathometer

Breathometer was a consumer health-tech startup founded in 2012 by Charles Michael Yim. Its first product was a small breath-alcohol tester that connected to a phone, so a user could get an estimate of their blood alcohol level on screen instead of using a standalone breathalyzer. A second device, the Breeze, followed under the same company. Yim appeared in Season 5, Episode 2, looking for $250,000 for a tenth of the company. The pitch is remembered because every shark on the panel that night, Mark Cuban, Kevin O'Leary, Daymond John, Lori Greiner and Robert Herjavec, ended up in the deal. Together they agreed to $1 million for 30%. Cuban took the largest single share. Business Insider reported the split at the time. The company's later story is less about growth than about accuracy. Federal regulators challenged whether the company could back up what it said about how precise its readings were, and the settlement that followed required refunds to buyers. The original devices are no longer sold. Cuban has since described the investment publicly as his worst on the show. Today there is no product to buy, and the company's legal status could not be confirmed from a public registry, which is why this page lists it as unknown rather than closed. For readers researching Shark Tank outcomes, Breathometer is a deal that drew the whole panel and later lost the sharks' money, by Cuban's account. Details of the regulatory case and Cuban's comments appear in the update below.

Breathometer Shark Tank update: is it still in business?

Breathometer is one of the most famous deals in Shark Tank history. Founder Charles Michael Yim pitched a keychain-sized breathalyzer that plugged into a smartphone's audio jack and paired with an app showing blood alcohol content. On the Season 5 premiere, which aired September 27, 2013, Yim asked for $250,000 for 10%. Business Insider reported that he left with all five sharks: $1 million for a combined 30%, with Mark Cuban putting in $500,000 for 15% and the other four sharks splitting the remaining $500,000 for 15%. It was billed as the first time every shark joined a single deal. What happened next is documented by the Federal Trade Commission. In January 2017, Breathometer, Inc. and Yim settled FTC charges that they lacked scientific support for accuracy claims about the Breathometer Original and Breeze, which the FTC said had sales of about $5.1 million. Under the order, the company had to notify buyers and offer full refunds, and Yim is barred from making unsupported accuracy claims. Cuban has since told the Full Send podcast in 2022, as reported by CNBC, that "all of the money's gone" and "that was my biggest beating." Is Breathometer still in business? The original breathalyzer products are discontinued. We could not confirm the company's current corporate status: breathometer.com did not respond when we checked on October 14, 2026, and we found no current filing to cite. We are marking status as unknown until we can verify it against a state registry. Cuban's comments indicate the sharks' money was invested, but we could not confirm exactly how much of the $1 million was funded after taping.
